France's law is inspired by the Roman law and the Code Napol?on; US' law is inspired by the Common Law. The consequences are that US is using an accusation model and France an inquisition model. In the US I can accuse you of a fraud and go to trial (that's why PIs are so common in the US); in France I cannot accuse you of a fraud, I believe I have suffered of a fraud by you and therefore I transmit this belief as a complaint to the equivalent of your DA "le procureur de la R?publique", then he is the one who will ask the police department to conduct an inquiry (Officier de police judiciaire). Then he will decide, looking at the conclusions of the police what to do with the complaint. Now how does this impact the praxis of psychoanalysis in these two countries? In the US it is pretty easy to accuse you of a misconduct as long as I have the money to hire the services of a PI. In France the procureur will first evaluate if the complaint is private or public. If I am the client of a psychologist the procureur will check if my psychologist has the legal right to practice his psychotherapy (diploma and so on). If I am the analysand of a psychoanalyst the procureur will automatically decide that this is a PRIVATE matter and that he has no right to intervene. Suppose I submit the following complaint; my wife dumped a piece of furniture I loved without asking this first, If I submit this complaint to the procureur he will dump the complaint! This is the same for psychoanalysis. I heard a judge explaining that in the course of a divorce the couple wanted the judge to decide of the rhythm of lodging for the dog! A dog is part of the furniture it's private. To conclude when we put forward the concept and signifier of lacanalysis we expect to be as close as possible as this official practice of psychoanalysis in France. Some kind of private practice.
